ORGANIZER AGREEMENT
This Organizer Agreement supplements the Skoryd Terms of Service and applies to all users who create clubs or organize events on the Skoryd platform.
1. Independent Organizer Status
You are an independent event organizer. You are not an employee, partner, agent, joint venturer, franchisee, or representative of Skoryd. Skoryd is a software platform provider only. No agency relationship, partnership, or employment relationship is created between you and Skoryd by your use of the Service or your role as an Organizer.
2. Sole Responsibility for Events
You are solely responsible for planning, creating, promoting, executing, supervising, and canceling any event you organize through Skoryd. Skoryd has no involvement in the operation, management, or oversight of your events. You assume all liability arising from your events, including but not limited to participant injuries, property damage, disputes, cancellations, and regulatory non-compliance.
3. You Are the Seller — Agent of the Payee
When participants pay an entry fee for your event, you are the seller and the responsible party to those participants. Skoryd collects entry fees exclusively as your limited payment agent (Agent of the Payee) and is not a party to the transaction between you and your participants. Skoryd's platform fee is deducted as disclosed at the time of event setup. The remaining proceeds are disbursed to you.
4. Legal Compliance
You are solely responsible for complying with all applicable local, state, and federal laws, regulations, and ordinances governing the events you organize. This includes, without limitation: required permits and licenses; venue agreements; liability insurance; health, safety, and accessibility requirements; and any applicable gambling, prize, or sweepstakes regulations. Skoryd makes no representation that use of the Service satisfies any legal requirements applicable to your events.
5. Accurate Event Information
You agree to provide accurate, complete, and up-to-date information about your events at all times, including dates, times, locations, rules, entry fees, eligibility requirements, and any material changes. You will promptly update event information when circumstances change and notify registered participants of any material changes.
6. Participant Safety
You agree to take commercially reasonable steps to protect the safety and well-being of all participants in your events. You agree to disclose known hazards or risks associated with your events to participants in advance. You acknowledge that physical activities like cornhole carry inherent risks and you accept responsibility for managing those risks at your events.
7. Refund Policy and Obligations
You agree to establish, communicate, and honor a clear refund policy for your events. All refund requests from participants are your responsibility to evaluate and fulfill. Skoryd's platform fees are non-refundable under all circumstances. If you cancel an event after participants have paid, you are responsible for issuing refunds in accordance with applicable law and your stated refund policy.
8. Indemnification
You agree to indemnify, defend, and hold harmless Skoryd and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) any event you organize through the Service; (b) your breach of this Agreement or the Skoryd Terms of Service; (c) your violation of any applicable law or regulation; or (d) any act or omission by you or your agents in connection with your events.
9. Entire Agreement
This Organizer Agreement is incorporated into and forms part of the Skoryd Terms of Service. In the event of any conflict between this Agreement and the Terms of Service, the Terms of Service shall control. Capitalized terms not defined here have the meanings given in the Terms of Service.
